General Terms and Conditions
Scope
- These general terms and conditions govern the legal relationship between the Zbynek Pavelcik – Elements Snowsports and his customers. The version that is valid at the time of contract completion is authoritative.
- Upon acceptance of services from the Zbynek Pavelcik – Elements Snowsports or making the reservation, the customer agrees to these general terms and conditions in full and without alterations.
- The object of the company is the operation of a private snow sports school. In particular, this includes services such as teaching snow sports skills and knowledge, without guaranteeing a specific training success, as well as guiding and accompanying by snow sports.
Conclusion of Contract
- By paying a service offer or a deposit, a contractual relationship is created. Services paid on the spot as well as reservations made via email or phone are considered confirmed reservations, provided a minimum deposit of CHF 100.00 is paid to the Zbynek Pavelcik – Elements Snowsports bank account.
- Zbynek Pavelcik – Elements Snowsports reserves the right to reject a customer’s order without giving a reason.
- The contract starts whenever the services of Zbynek Pavelcik – Elements Snowsports are used.
- The bookings are personal and non-transferable.
Cancellation, Service Offer of the Zbynek Pavelcik – Elements Snowsports
- Cancellation of the reservation must be made no later than 24 hours before the start of the service. Otherwise, 100% of the service price will be charged. If the reservation is canceled or changed less than 15 days before the start of the lesson, 80% of the total price of the service + a cancellation fee of CHF 70.00 will be charged.
- If the course or lesson cannot take place due to a total breakdown of the transport systems or the suspension of the transport systems due to weather, the lesson in question will be counted. This is done only in the form of vouchers; no cash payments will be made.
- Each started service will generally be charged in full.
- Lessons generally take place in all weathers, unless transport systems are suspended due to weather. Weather restrictions, bad weather, avalanche danger, etc. do not entitle you to a refund or any compensation.
- Zbynek Pavelcik – Elements Snowsports reserves the right to change, cancel or interrupt the program or individual services after the conclusion of the contract and also during the activity in case of natural and/or weather conditions or other unforeseeable circumstances (force majeure, official and/or security measures or other risks) if necessary.
- Refunds will only be made in the event of an accident or illness upon presentation of a local medical certificate. In case of late arrival or early termination of the activity, there is no right to a refund. If the customer is late for the agreed lesson, the lesson will be held until the agreed end of the lesson or the end of the lesson period.
- The use of lifts and cable cars is not included in the price of the lesson. Zbynek Pavelcik – Elements Snowsports does not refund any compensation for missed lessons due to cable cars or lifts failure.
- All offers are subject to change and are non-binding. Zbynek Pavelcik – Elements Snowsports expressly reserves the right to change, supplement or delete parts of the services or the entire range of services without prior notice.
Prices
- Prices are given in Swiss francs. For payments in another currency, the daily exchange rate of Raiffeisenbank Surselva is used.
Payment
- By bank transfer to account CH45 8080 8004 5885 1222 3, Zbynek Pavelcik, Via Maghers 12, 7032 Laax.
- In cash at the end of the lesson at the latest.
- Refunds for canceled reservations will be made in cash or by bank transfer.
Privacy
- Zbynek Pavelcik – Elements Snowsports points out that personal data will be saved during the course of contract completion. Zbynek Pavelcik – Elements Snowsports observes legal requirements related to data protection when processing personal data.
- Zbynek Pavelcik – Elements Snowsports may forward customer data to third parties if required to do so in the provision of its services.
- If it discovers illegal or unethical conduct, Zbynek Pavelcik – Elements Snowsports may forward customer data to third parties, namely legal authorities. The customer is also advised that Zbynek Pavelcik – Elements Snowsports can be required to hand over customer data to courts and other authorities.
Liability
- Zbynek Pavelcik – Elements Snowsports is not liable for accidents that occur before, during or after the lesson. Insurance is the responsibility of the participant.
- Customers must strictly follow FIS safety rules and the instructions of the Elements Snowsports instructor.
- Liability claims against Zbynek Pavelcik – Elements Snowsports relating to material or immaterial damage caused by the use or non-use of the information provided or by the use of incorrect or incomplete information are generally excluded, unless Zbynek Pavelcik – Elements Snowsports can be proven to have acted with intent or gross negligence.
Governing Law and Jurisdiction
Swiss law applies exclusively. Place of jurisdiction is Laax. Tariff changes and printing errors reserved. Laax 1.11. 2022
